The department said the current framework, introduced in 2004, no longer reflected the way companies recruit and employ staff today. The proposed changes could impose stricter requirements on employers seeking to sponsor foreign nationals for permanent residence.

Why does the United States want to change PERM rules?

The Department of Labor wants to modernize the PERM system to reflect changes in the labor market, particularly the shift to digital recruiting.

When the current framework was introduced in 2004, employers relied more heavily on traditional recruitment methods. Today, companies are increasingly using online job platforms and digital recruiting tools to find candidates.

What will happen to green card sponsorship?

Companies may be required to more clearly demonstrate that they have attempted to recruit qualified U.S. workers before sponsoring foreign workers.

The updated process may also consider recent layoffs during labor certification review, adding another factor for employers seeking to hire foreign professionals.

The broader goal of the proposed reforms is to increase oversight of employment-based immigration while ensuring that American workers receive meaningful consideration in the hiring process.

What is PERM? Why is it important?

PERM, or Program Electronic Review Management System, is a mandatory labor certification step for many employment-based green card applications. Before sponsoring a foreign worker for permanent residence, the employer must complete the PERM process and demonstrate that there are no qualified U.S. workers available for the position.

Once the PERM is approved, the employer can usually move on to the next phase of the employment-based green card process.

The program is particularly important for industries that rely on skilled foreign workers, including technology, engineering, health care and research.

What does this change mean for Indian workers?

The proposed reforms are likely to be closely watched in India, as Indian professionals make up a large share of U.S. employment-based immigration applicants.

Many Indian technology professionals rely on employment-based Visa routeincluding H-1B visas, and then permanent residency through employer sponsorship.

Indian IT companies and U.S. technology companies have historically been among the largest users of employment-based immigration programs.

If implemented, the PERM changes could mean more documentation, stricter hiring requirements and additional compliance steps for employers to sponsor foreign workers. However, the proposed changes would not immediately change the status of existing green card holders or applicants.

The PERM reforms come amid broader changes to employment-based immigration under the Trump administration. The government has reformed the H-1B visa system and proposed measures related to foreign worker wages.
