Investigators were shown surveillance video that allegedly showed Ethely shooting Joshua Fox before any physical assault occurred, the post said.The video is related to the May 13 shooting outside the Montgomery County Courthouse. Fox, a disabled veteran and father of three, and his wife were at the courthouse for a child support hearing when the conflict occurred.Investigators said Isserly approached Fox and a verbal argument ensued. Iserley walked away briefly and then turned back to Fox, court testimony said. Prosecutors said he then reached for a gun, causing the situation to escalate. A fight ensued and multiple shots were fired.Authorities recovered seven shell casings from the scene. Foxx was hit several times and underwent emergency surgery. Iserley also suffered a gunshot wound to his arm during the fight.

Etherly currently faces serious felony charges including attempted murder, use of a firearm in the commission of a dangerous felony, aggravated assault and reckless endangerment.Judge Melissa Blackburn cited Ethely’s behavior and online activity in her decision to revoke bond, according to a report from the hearing. She reportedly said the decision was based on “what I’ve seen on social media and Mr. Iserley’s behavior.”The bail revocation means Iserley remains in custody even as the larger case continues in Montgomery County. Prosecutors insist the surveillance footage weakens his self-defense argument and that a final determination of guilt or innocence will be made in future court proceedings.
