Legal and investigative experts say the no-man case remains legally viable, but only if investigators can build a strong enough chain of evidence. Criminal defense attorney Michael T van der Veen told Newsweek: “Prosecutors can prove this indirectly because the judge gives instructions to the jury…Circumstantial evidence is as strong, if not stronger, than direct evidence. Through indirect evidence, prosecutors can prove the principal of the crime, or the ‘subject of the crime.'”

He added that Nancy’s age and health made voluntary disappearance highly unlikely. “She is 84 years old, wears a pacemaker and needs to take daily medication… The likelihood that she disappeared voluntarily is very low,” he said.

Daniel K Maxwell, a former police officer and professor of criminal investigation, told Newsweek that in cases where no one is missing, physical and behavioral evidence becomes even more important. “Any physical evidence is important. Direct evidence includes photos, videos and eyewitness testimony. Indirect evidence includes fingerprints, blood, hair, fibers. Indirect evidence also plays an important role… including the suspect’s behavior before and after the disappearance,” he said.

“Evaluating the credibility of a report includes specificity, plausibility and consistency with the facts of the case. The more detailed and verifiable the report, the better,” Maxwell said in evaluating the new Mexico tip. newsweek.
