NEW DELHI: With no witness called to record oral evidence in 35 years, the Supreme Court has stayed proceedings in the trial of a police officer, indicating that it favors quashing the case solely on the grounds of delay. A bench of Justices JB Pardiwala and Vijay Bishnoi issued notice to the Uttar Pradesh government seeking its response as to why the case should not be dismissed.
The officer is facing trial under IPC sections 147 (rioting), 323 (causing hurt) and 504 (insult) and Section 120 of the Railway Act. The case is being heard before the court of Additional Chief Judicial Magistrate (Railway) Prayagraj.
