The Manhattan District Attorney’s Office reached a slap on the wrist plea deal with Nicol Alexandra Contreras-Suarez, a 31-year-old transgender woman from New York. Colombia. The 2025 attack on the 14-year-old boy occurred in East Harlem.

The convicted rapist was sentenced to just six months in prison. That term has expired.

Light sentence sparks outrage

Mark Bedlow, a New York City defense attorney and former prosecutor in the Manhattan District Attorney’s Office who has handled numerous rape cases, was shocked by the verdict. “Traditionally, people prey on children, follow them somewhere and rape them – it’s a horrific crime,” he said.

Bedlo called the six-month jail sentence “very low.”

Given Contreras-Suarez’s immigration status, which meant he was wanted in another state for other violent crimes at the time of the attack, “this kind of client doesn’t typically elicit a lot of sympathy,” Bedlo said.

“Normally, the minimum sentence for this offense is two years, unless the court finds mitigating circumstances and records them,” he added.

“I don’t know what those are in this case, other than the fact that they want to exempt the children from testifying and that the defendant is going to be deported,” he further said. “It doesn’t look good for a district attorney to give this guy a light sentence because he’s scheduled to be deported, because a lot of people are not deported.”

“That’s understandable to a certain extent in terms of not wanting a child to testify and be re-traumatized. But it’s certainly a very sweet deal for someone who committed a horrific crime,” he explained.

Officials reached the resolution in close consultation with the victim’s family, according to District Attorney Alvin Bragg’s office. The teen did not testify to the grand jury for many days of the trial.

After Judge Michelle Rodney accepted the request at a hearing in Manhattan Supreme Court on Tuesday, a spokesperson for the District Attorney’s Office said, “As a result of the felony conviction, we anticipate that the defendant will remain in custody and will be deported upon sentencing.”

That sends a shocking message, said Jennifer Harrison, a critic of Bragg and founder of the New York-based Victims Rights Advocacy Group.

“Let us not pretend that this sentence reflects true justice. It does not. It sends a dangerous message that even the most horrific crimes against children will not be met with the full force of the law,” she told the New York Post.

“What message does this send beyond this case? A predator can come into New York, rape a child, destroy their life and still expect leniency,” she added.

Contreras-Suarez, who was born male, will be released from prison next month unless federal authorities manage to intervene and deport them from the country.

The criminal complaint states that on February 11, 2025, Contreras-Suarez was walking a white Pomeranian when they followed the victim into a grocery store bathroom across from Thomas Jefferson Park. They then attacked and sexually assaulted him.

After the attack, the victim waved to onlookers. Contreras-Suarez was arrested and charged the next day.

The suspect was wanted in New Jersey and Massachusetts. They are the subject of ICE detention in these states.

Contreras-Suarez was arrested in Medford, Massachusetts on charges of armed robbery, prostitution and assault with a dangerous weapon. However, the Department of Homeland Security said in July that they were being released due to local asylum policies.
