Justice Jyoti Singh said: “The legally dubious circumstances raised by the plaintiff must be completely eliminated by defendant No. 1 (Priya Kapur) before the document can be accepted as the last will and testament.”
She said the plaintiffs “have made a prima facie case and the assets need to be protected and preserved before the proceedings can be dealt with”.
Priya’s invocation of the will was disputed by Sanjay’s children from his previous marriage to actor Karisma Kapoor.
The judge said that if the assets were not retained and Priya ultimately failed to prove the validity of the will, Sunjay and Karisma’s children Samaira and Kiaan, as well as his mother Rani Kapur, would be deprived of their legal share of the estate.
The interim order freezes the deceased’s shareholdings in three Indian companies and restricts the disposal of his personal belongings, including works of art.
Priya is prohibited from withdrawing funds from her late husband’s provident fund and from accessing funds in her Indian bank account unless the withdrawal is to fulfill Sunjay’s obligations related to his divorce from Karisma. The court also banned her from operating foreign bank accounts and cryptocurrency assets.
The order does not bind Sunjay’s foreign real estate. Priya’s legal team argued that these did not fall within the purview of the HC as per the jurisdiction.
Sunjay collapsed and died during a polo match in England on July 12 last year. He reportedly went into cardiac arrest after swallowing a live bee.
