SC rejects Pawan Khera’s plea for protection from arrest
New Delhi: Supreme Court Congress neta Pawan Khera on Friday moved a plea for interim protection from arrest till Tuesday and asked him to approach an Assam court seeking anticipatory bail against the state’s chief minister who has filed an FIR against him Himanta Biswa Sarmawife. A bench of Justices JK Maheshwari and AS Chandukar refused to modify the order passed on Wednesday, which had stayed the Telangana HC order granting him transit anticipatory bail. Kaira’s senior lawyer Abhishek Manu Singhvi said he was ready to move court in Assam but sought protection for five days as the petition could be filed only on Monday. But the judge rejected the request, saying he could file the petition on Friday or Saturday and request an emergency hearing even if the court in question is not working. “…We have once again made it clear that following the application filed by accused No. 1 (Khera) seeking anticipatory bail, the decision of the court on the bail application shall not be adversely affected by any observations made in the April 15 order of this court suspending transit bail.…,” the bench said.
