Comments Off on H1 Visa Stamping: Can Social Media Activity Delay U.S. Visa Approval? What applicants need to know

A Reddit post H1-B visa The applicant sparked discussion online after claiming his U.S. visa stamping was delayed due to issues regarding social media activity during a consulate interview.

The applicants wrote that they attended their visa interviews on May 12 and received a denial notice under Section 221(g), a term commonly used when U.S. consulates require additional administrative processing or document inspections before making a final decision.

What the Reddit post claims

according to Reddit userAfter the interview, consular officials initially withheld the applicant’s passport and asked whether his social media accounts were public.

Applicants indicated that their answer was “yes.” However, a week later, the passport was returned without a visa stamp and with another 221(g) notice, which stated: “Social media – available to the public – may not be deleted.”

The user also claimed that they initially listed only active social media accounts on their DS-160 visa application form, but later emailed the consulate with more account details after being notified. Nearly 40 days later, the visa status allegedly still shows “denied.”

The post prompted some reactions, with commenters questioning the meaning of the term “no deletion” and whether applicants were informally advised not to delete social media content during administrative inspections.

What is 221 (grams)?

Section 221(g) of the U.S. Immigration and Nationality Act allows consular officers to temporarily deny a visa application pending further review, security clearance, or other documentation.

Immigration attorneys often point out that a 221(g) denial is not always a permanent denial. In many cases, applicants are ultimately approved after administrative processing is completed.

As part of the DS-160 application process, the United States has required most visa applicants since 2019 to disclose social media identifiers used in the past five years.

H1-B visa under scrutiny

The discussion comes amid a broader debate over the U.S. H1-B visa program.

The H1-B visa allows U.S. employers to hire foreign workers in specialized occupations that require technical expertise or an equivalent bachelor’s degree. Technology companies, universities, hospitals and research institutions are the largest users of the program.

A federal judge recently rejected Donald Trump’s proposed $100,000 H1-B visa fee, ruling that the administration exceeded its authority by imposing the fee without congressional approval, an issue that remains politically sensitive, the Associated Press reported.

Supporters of the H1-B system argue that the program helps U.S. companies fill skilled labor shortages, while critics claim it will make U.S. companies less competitive american workers and wages.

While there are no publicly announced new laws directly linking visa approvals to social media activity, immigration forums and applicants are increasingly reporting longer administrative processing times and the need for additional review in some H1-B cases.
