What is “reasonable doubt”?
The standard represents the burden prosecutors must meet to secure a criminal conviction. In other words, jurors must be firmly convinced of a defendant’s guilt after considering the evidence presented in court.
In Clancy’s case, the question is whether prosecutors have established beyond a reasonable doubt that she was legally sane and criminally responsible when her three children were killed.
Jury remains unable to reach verdict
The 12-member jury, made up of nine women and three men, has now indicated on multiple occasions that it remains divided. Jurors have told Sullivan they are unable to reach a unanimous decision despite being instructed to continue deliberating.
What does a juror deadlock mean?
The continuing impasse has increased the possibility of a hung jury and a potential mistrial.
Under Massachusetts law, a unanimous verdict is required. If jurors ultimately cannot agree, the judge could declare a mistrial, leaving the case without a verdict.
A hung jury would not amount to either a finding that prosecutors failed to prove the case or a declaration that Clancy is not guilty. Instead, the case would remain unresolved.
Prosecutors could pursue another trial
Following a mistrial, prosecutors would have several options. They could bring the case before a new jury and begin another trial, attempt to negotiate a plea agreement with Clancy’s defense team, or decide to dismiss the charges.
Clancy would remain in custody
A mistrial would not automatically end the legal case against Clancy or result in her immediate release. The murder charges would remain in place while prosecutors and her attorneys determine the next course of action.
Clancy would continue to be held at the mental health facility where she is currently housed as both sides consider what comes next.
Jury to resume deliberations Friday
Jurors in the Lindsay Clancy murder trial wrapped up their sixth day of deliberations Thursday without reaching a verdict.
The 12-member panel has now spent roughly 36 hours deliberating over six days, with more than half of that time reportedly coming amid disagreements over the verdict.
The jury is scheduled to return Friday for a seventh day of deliberations as the possibility of a hung jury continues to loom over the closely watched case.
