Alito’s reaction as Sotomayor read her dissent

As Sotomayor sat on the bench reading her 35-page objection, Alito spent more time than her colleagues leaning back in his chair, rocking back and forth, staring at the ceiling and at times appearing to close his eyes, The Hill reported.

As Sotomayor criticized the majority’s views as “extremely wrong,” Alito leaned forward in his chair, resting his chin on his hands and staring at the ceiling.

When Sotomayor commented on the majority opinion’s language referring to “arrival” in the context of immigration, and used the example of landing Reagan washington National Airport, Alito briefly set his sights on Sotomayor.

After Sotomayor finished speaking, Alito quietly cleared his throat in a rare off-the-cuff response. Alito looked upset and said that if he had known she would read her objection in its entirety, “I would have added more to my comments.”

Alito also urged people to read his full opinion to see how he responded to Sotomayor’s arguments. He also noted that the immigration policies at the heart of the case have been adopted by both Democratic and Republican administrations. However, he said no more, adding: “I won’t add anything more.”

The case is at the center of the conflict

Alito began by briefly summarizing his majority opinion in Mullin v. Al Otro Lado, which held that the government has the authority to return immigrants stopped at the U.S. border before giving them a chance to apply for asylum, the New York Post reported.

It is not routine practice for the justices to read dissenting opinions from the justices, but they are occasionally done to express strong dissent from a majority ruling.
