Why Harvey Weinstein’s Jessica Mann rape retrial ended in mistrial – The jury’s verdict explained

Harvey Weinstein’s latest rape retrial in New York ended in a mistrial on Friday as the jury failed to unanimously decide whether he raped aspiring actress Jessica Mann. After about three days of deliberations, the jury told the court it was deadlocked on a third-degree rape charge against Weinstein for a 2013 assault on Mann in a Manhattan hotel room.

Judge Curtis Farber ultimately declared a mistrial after concluding that jurors could not break the deadlock.

Farber said outside the jury’s presence that it was clear they were “hopelessly deadlocked” and there was no reason to continue deliberations.

Prosecutors now have 30 days to decide whether to try Weinstein a fourth time on the same charges.

What was the reason for the jury deadlock?

The retrial focuses on a sharply conflicting account of Weinstein’s relationship with Mann. Prosecutors argued that the former Hollywood producer used his influence and power in the industry to force Mann to perform sex acts and that she repeatedly resisted and said “no.”

Mann testified for five days during the trial, repeating allegations she had previously made to both juries.

However, Weinstein’s defense team argued that the relationship between the two was consensual and claimed that Mann later rescheduled the meeting when she became frustrated that her relationship with Weinstein would not advance her acting career.

Defense attorneys pointed out that Mann allegedly sent Weinstein messages after the encounter, including messages like “Miss you, big man” and “Thank you for everything you’ve done for me.”

The jury’s inability to reach consensus mirrored divisions that arose during Weinstein’s previous retrial in New York in 2025, when the jury also deadlocked on Jessica Mann’s rape charges.

Weinstein convicted on separate sexual assault charges

Although the rape charges involving Mann ended in a mistrial, Weinstein was separately convicted in June 2025 of sexually assaulting former production assistant Miriam Haley.

The conviction came after a Manhattan jury found Weinstein guilty of sexually assaulting Haley in 2006.

In the same trial, a jury acquitted Weinstein on charges involving former model Kaya Sokola.

Judge Farber delayed sentencing on Weinstein’s conviction against Haley until the pending Mann charges are resolved. Weinstein faces up to 25 years in prison when convicted of Haley’s crime.

Why is Weinstein being retried again?

Weinstein was initially convicted in 2020 in New York, where a jury found him guilty of raping Mann and assaulting Haley and was sentenced to 23 years in prison.

However, the New York Supreme Court later overturned the conviction, ruling that Weinstein did not receive a fair trial due to disputed testimony and procedural issues.

The decision forced prosecutors to reopen the case.

The retrial begins in April 2026, again focusing on the charges related to Mann and Haley.

Weinstein remains behind bars despite mistrial

Despite the mistrial, Weinstein is expected to remain incarcerated due to his other convictions. In 2022, Weinstein was convicted in Los Angeles of raping an Italian model during a 2013 film festival. He was sentenced to 16 years in prison for the case and is appealing his conviction and sentence.

Weinstein, once one of the most powerful producers in Hollywood owned by Miramax, has always denied sexually assaulting anyone or engaging in non-consensual sex.
